TERMS OF SERVICE

1 General

This Web Site is intended only for consumers wishing to online order digital music stand products and accessories (“Products”) produced (under the SCORA brand)  and/or selected by Triangle Solutions for delivery worldwide. The terms and conditions under which the Products are offered for sale on this Web Site are set out below. By ticking the “I have read and agree” box on the order form and submitting the order, you accept and agree to be bound by these terms and conditions. Triangle solutions reserves the right to change these terms and conditions at any time without prior notice. Such change however will have no effect on orders that were submitted before posting of such revised terms and conditions on this Web Site.

2 Order placement

To place an Order you must be 18 years of age or over, be accessible by telephone and have a valid email address.

You may place an order by filling in the order form on the Web Site after logging into or creating your personal account and clicking on the appropriate submission button.

When you place your order, you will be issued with a Web Order Number. This Web Order Number is supplied for reference purposes only and does not constitute our acceptance of your order.

By placing an order, you make an offer to us to purchase the Products you have selected on these terms and conditions. Triangle Solutions may or may not accept your offer at our discretion or may reduce the number of Products we accept to deliver to you. However, orders submitted by you are binding on you and cannot be cancelled after order submission.

If Triangle Solutions accepts your order, Triangle Solutions will notify you of our acceptance by issuing an order confirmation. Triangle Solutions will send your order confirmation to you by e-mail The order confirmation will be effective as of the date on which the order confirmation is sent to you. If Triangle Solutions cannot accept your order, Triangle Solutions will attempt to contact you by email or telephone or post.

Please note that the on-screen display of the colors may differ from the actual appearance of products offered on the Web Site.

3 Supply of products

Subject to these terms and conditions, Triangle Solutions will supply to you the Products indicated on your order confirmation. Shipments are normally dispatched the next business day after receipt of the order. In case this timeline cannot be met, we will clearly indicate this in the confirmation mail. If the delivery time does not need your needs, you can request a cancellation of the order, which we will then fully refund to you.

4 Prices

All prices are in EURO. Prices shall be those prices published on this Web Site at the time you submit your order. The prices published on the Web Site are inclusive of VAT but exclusive of recycling levies, shipping and handling costs and duties, which are for your account. These costs will be calculated separately as applicable and specified on the order form and added to the total price of the order. The total price stated on the order form you submit shall be the total amount payable by you for the products including all taxes, recycling levies, duties, handling and shipping charges.

No intra-community purchases can be made via the Web Site. If you wish to make such order, please contact us directly.

VAT will not be charged for deliveries outside of the EU.

5. Paying for Your Products

You may pay for your Products by the methods of payment as may be displayed on the payment paragraph of the Web Site.

You must pay in the currency as indicated on your invoice.

6 Delivery of Your Products

Triangle Solutions will deliver the Products to the delivery address you have specified in the order form and in accordance with the delivery option you have chosen. In the event you order various Products to be delivered to different addresses, you will need to submit a separate order form for each delivery address. Any delivery or shipment dates given by Triangle Solutions are best estimates only and Triangle Solutions shall not be liable for any loss, damage, costs or expenses for failure to deliver in accordance with the delivery or shipment dates given.

Title to and risk of loss in your Products will pass to you on delivery of the Products.

Upon delivery of the Products to the carrier Triangle Solutions will send you a confirmation of shipment by e-mail provided you have indicated an e-mail address on the order form or by post.

7 Withdrawal

7.1 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (see contact details in section 5) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the standard model withdrawal form found at http://www.scorashop.com/withdrawalform, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

7.2 Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods to Triangle Solutions, Vuggelberg 11, 3270 Scherpenheuvel, Belgium, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

We suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed. If you are shipping an item over €/$75, you should consider using a trackable shipping service or purchasing shipping insurance.

 

8 Warranty

8.1. SCORA-branded Product Warranty

Triangle Solutions warrants the normal functioning of its Products for 2 years from the date of purchase.

Elements of the product that are susceptible to normal wear and tear (such as batteries) are warranted for 6 months.

Mechanical damage is explicitly excluded from warranty claims.

With respect to software, no warranty shall apply other than as expressly set forth in the applicable license agreement. Should the Product supplied by Triangle Solutions not comply with the applicable warranty Triangle Solutions shall, at its option and expense, unless provided otherwise in the applicable warranty, repair or replace the Product or refund the purchase price upon return of the Product. Except as expressly set out in these terms and conditions, to the fullest extent permitted by law Triangle Solutions hereby disclaims any and all warranties, whether express or implied. The limited warranty set out above will not affect or prejudice your statutory rights. 

8.2. Non-SCORA-branded/Third-party Products

For non SCORA-branded Products (including non SCORA branded products contained in product bundles or promotions), all warranty claims, where relevant, are to be made in accordance with the terms and conditions of any standard manufacturer’s warranty which may be included with the Products purchased. In relation to any existing manufacturer’s warranty, any warranty claims should first be made either directly to the manufacturer or to Triangle Solutions by phone. 

8.3. Statutory rights

THE WARRANTIES REFERRED TO ABOVE ARE IN ADDITION TO AND DO NOT AFFECT YOUR STATUTORY RIGHTS.

9 Triangle Solutions Liability

These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the Products (and performance of telephone support and warranty services) and the performance of any Services.

Save as set out at the paragraph below, there are no warranties, conditions or other terms that are binding on Triangle Solutions regarding the supply of Products or the provision of Services except as expressly stated in the contract.

Any warranty, condition or other term arising out of or in connection with the supply of Products and/or the provision of Services which might otherwise be implied into or incorporated in the contract by statute, common law, laws applicable in the country where you purchased the Products or Services or otherwise (including without limitation any implied term as to quality, fitness for purpose, reasonable care and skill) is hereby expressly excluded to the maximum extent permitted by law. In particular, Triangle Solutions will not be responsible for ensuring that the Products are suitable for your purposes

Nothing in the contract shall limit or exclude our liability (i) for death or personal injury caused by our negligence or (ii) for fraud or (iii) any breach of the obligations implied by applicable compulsory national laws as to title or (iv) any liability which cannot be excluded by law.

This does not affect your statutory rights as a consumer, nor your right to return the Products as per clause 7.

10 PRIVACY POLICY

10.1 WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer's IP address in order to provide us with information that helps us learn about your browser and operating system.

10.2 EMAIL MARKETING

With your permission, we may send you emails about our store, new products and other updates.

10.3 CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

10.4 CONSENT WITHDRAWAL

10.5 DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

10.6 ONE.COM

Our store is hosted by One.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through One.com's data storage, databases and the general One.com application. They store your data on a secure server behind a firewall.

10.7 PAYMENT

If you choose a direct payment gateway to complete your purchase, then our third-party payment gateway might use your credit card info for that purpose. See 10.8.

10.8 THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

10.11 AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to modify our terms of service at any time, so please review it frequently.

Changes and clarifications will take effect immediately upon their posting on the website.

If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
